20973 abstract This article examines the relationship between the criminal and civil liability for unlawful corporate conduct.Where there is a crime of gross negligence there is inevitably a civil wrong of negligence, and the Civil Evidence Act 1968 allows for the criminal conviction to be used as evidence in the civil proceedings. This article examines the current developmental state of the law and argues that the Civil Evidence Act mechanism is probably underused because corporate crime is under-prosecuted.
